Required in Every Civil Case

Courts cannot enter a default judgment against a defendant without an SCRA Declaration. This is a federal requirement under 50 U.S.C. § 3901. File with every default judgment motion.

How to Check Status

Search the DoD SCRA database free at scra.dmdc.osd.mil — results are instant and provide a printable certificate. Search by SSN or date of birth. The certificate is your source document.

If Defendant is Active Duty

Active duty servicemembers are entitled to a stay of proceedings of at least 90 days. The court may appoint an attorney to represent them. Entry of default is prohibited. You must notify the court immediately.

ATTORNEY USE ONLY. One SCRA investigation per defendant. Each defendant requires a separate entry. File this declaration with every motion for default judgment — courts will reject a default without it.
