Who Qualifies for a DVPO

A Domestic Violence Protective Order (50B order) is available to persons who have experienced acts of domestic violence committed by someone with whom they have a qualifying relationship. Qualifying relationships under N.C.G.S. § 50B-1(b) include: current or former spouses; persons who live together or have lived together as spouses; persons who share a child in common; parents and children or grandparents and grandchildren; current or former household members; and persons who are or have been in a dating or romantic relationship.

What the Forms Are

CV-303 — Official NC Courts instructions that walk you through the filing process. These instructions (the document on this page) explain your rights and what to expect.

CV-306 — The Complaint and Motion for Domestic Violence Protective Order. This is the primary form you file to initiate a DVPO action. You describe the acts of domestic violence and request specific relief from the court.

CV-307 — The Ex Parte Domestic Violence Protective Order. This is the temporary order a judge may issue on the same day you file, without the defendant present. It remains in effect until the 10-day hearing.

03

The 3-Step Process

Step 1 — File: Take your completed CV-306 to the Clerk of Superior Court in your county. There is no filing fee for a DVPO. The Clerk will assign a file number and schedule you for an ex parte hearing.

Step 2 — Ex Parte Hearing: You will appear before a judge, usually the same day, without the defendant present. The judge will review your CV-306 and may issue a temporary protective order (CV-307) if the facts support it. The order is then served on the defendant by the sheriff.

Step 3 — 10-Day Hearing: A full hearing is scheduled within 10 days. Both parties appear and can present evidence. The judge may enter a permanent DVPO for up to one year, which can be renewed.

Do You Need an Attorney?

You do not need an attorney to file a DVPO. The Courthouse Clerk can assist you with paperwork, and judges are accustomed to hearing from unrepresented parties in 50B proceedings. The process is designed to be accessible without legal representation.

However, if the defendant plans to appear at the 10-day hearing with their own attorney, the dynamics change significantly. An opposing attorney will cross-examine you, challenge your evidence, and present counter-arguments. Having legal representation at the 10-day hearing substantially improves your chances of obtaining a permanent DVPO.
