WHAT IS A MOTION TO CONTINUE?
A Motion to Continue asks the court to reschedule a criminal hearing to a future date. Filed when the defense attorney, client, or a witness cannot appear — or when more time is needed to prepare.
The judge rules on the motion, often without a hearing. Good cause must be shown. Continuances are generally granted for legitimate scheduling conflicts, medical issues, or ongoing negotiations.
